What this covers

A family can offer a book their child made to our shared library, and a person reads it before any other family can see it. If you believe a book there copies your work, this is where to tell us. A book a family keeps to themselves is never shown to anybody else.

What a notice needs

The law sets out what a notice has to include. Please send all of it:

• Your physical or electronic signature, as the copyright owner or as somebody authorised to act for them.
• The work you believe has been copied.
• The book on our site that you believe copies it, with enough for us to find it, such as its title and a link to it.
• Your name, postal address, telephone number and email address.
• A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for the owner.

If something is missing, we write back to say what, rather than setting the notice aside.

What we do next

We take the book out of the shared library, so no other family can see it. The family who made it keeps their own copy. We tell that family what happened and that they can send a counter-notice, and we keep a record of every notice we receive.

Counter-notices

If a book of yours was taken out of the shared library and you believe that was a mistake, the grown-up who holds the account can send a counter-notice to the same address. It needs:

• Your physical or electronic signature.
• The book that was taken out, and where it appeared before that.
• A statement, under penalty of perjury, that you believe in good faith that the book was taken out by mistake or because it was misidentified.
• Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if your address is outside the United States, any district where Optiarms, Inc. may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We send a copy of a complete counter-notice to the person who sent the original notice. Unless they tell us they have gone to court to keep the book down, we put it back in the shared library between ten and fourteen business days after we receive the counter-notice.

Repeat infringers

We keep count of the complete notices we receive about each account, and in appropriate circumstances we close the account of anybody who infringes copyright repeatedly.

Before you send one

Knowingly claiming that something infringes when it does not can make you liable for damages under 17 U.S.C. § 512(f). If you are not sure whether a book copies your work, write to us first and ask.
